Conversation coaching and private lessons

Service provider. Delphine Untereiner - DIV’in’English / DIVE with Delphine is a sole proprietor based at 133 rue Alphonse Laveran, 83220 Le Pradet, France. The business provides online private French and English lessons, refresher lessons, language coaching and conversation coaching to individual clients. The “Client” means any individual purchasing one of these services for personal purposes.

Scope and acceptance. These Terms and Conditions apply exclusively to private lessons, refresher lessons, and language or conversation coaching. Placing an order or accepting or signing a quote constitutes the Client’s full acceptance of them.

Fees and payment. Prices are stated in euros and are net of tax. The payment schedule, number of sessions and any installment dates are specified in the quote accepted by the Client. Payment may be made in full or in installments, as stated in the quote. The first payment must be received no later than before the first session begins. Any subsequent installment must be paid before the corresponding period begins; no new session or billing period will begin if the relevant payment has not been received.

14-day right of withdrawal. The Client has a statutory 14-day right of withdrawal from the date the contract is concluded and may exercise it by sending a clear statement to divewithdelphine@gmail.com. If the Client wishes the sessions to begin before the end of that period, they must expressly request this. If the Client withdraws after the service has begun at their express request, they remain liable for the services actually provided. If the service has been fully performed before the end of the period, following the Client’s express request and acknowledgement, the right of withdrawal is lost.

Sessions. The schedule is agreed with the Client. Sessions are delivered online, including via Zoom or Teams. Connection details are provided before the session.

Cancellations, rescheduling, no-shows and termination. Any cancellation or request to reschedule must be made at least 48 hours before the scheduled start time. Otherwise, the session is considered used and cannot be refunded or rescheduled, except in a duly justified case of force majeure. A no-show without prior notice is also considered a used session. After two no-shows without prior notice, Delphine Untereiner - DIV’in’English may end the coaching arrangement after informing the Client in writing. For services paid monthly or by billing period, termination takes effect at the end of the period already paid for. For a package paid in full, sessions already provided or due remain payable; if Delphine Untereiner terminates the arrangement, remaining unused sessions are refunded.

Obligations and force majeure. Delphine Untereiner - DIV’in’English is subject to a best-efforts obligation and does not guarantee any specific language-learning result. The business shall not be liable for failure to perform resulting from force majeure or circumstances reasonably beyond its control.

Intellectual property, confidentiality and personal data. All materials and documents provided remain the exclusive property of Delphine Untereiner - DIV’in’English. They may not be reproduced, shared or used for purposes other than strictly personal use without prior permission. Information shared during lessons or coaching is treated confidentially. Rights of access, rectification, restriction, objection and deletion may be exercised by contacting divewithdelphine@gmail.com.

Complaints, governing law and jurisdiction. If a problem arises, the Client should first send a written complaint to divewithdelphine@gmail.com so that an amicable solution can be sought. These Terms and Conditions are governed by French law. In the event of a dispute with a consumer Client, jurisdiction is determined in accordance with the applicable legal rules. If the French and English versions differ, the French version prevails.

Clarity Session

Purpose. The Clarity Session is a one-to-one coaching session designed to help the Client step back, gain clarity on a situation, and explore their own possible next steps. It is not psychotherapy, medical or psychological treatment, or legal or financial advice. The Client remains responsible for their own decisions and actions.

Booking and payment. The booking is confirmed once full payment has been received. The applicable fee is the price communicated or displayed at the time of booking.

Cancellation or rescheduling. A session may be canceled or rescheduled free of charge up to 48 hours before the scheduled appointment. After this deadline, the session remains due, except in exceptional circumstances accepted by the provider. If the provider cancels, the session is rescheduled or fully refunded.

Right of withdrawal. Consumers booking remotely have a statutory 14-day right of withdrawal under French law. If the Client wishes the session to take place before the end of this period, they expressly request that the service begin before the withdrawal period expires by ticking the appropriate box on Calendly. Once the service has been fully performed, the Client acknowledges that they lose their right of withdrawal in accordance with applicable law.

Confidentiality and responsibility. Information shared during the session is treated as confidential, subject to applicable legal obligations. The provider facilitates a process of reflection and clarification but does not guarantee any specific outcome.

Governing law. These Terms and Conditions are governed by French law. By booking a session, the Client confirms that they have read and accepted them.

The information sent through the site’s forms (name, email address, universe or session, message, availability) is used only to answer your request and organize the appointment.

It is neither sold, nor transferred, nor used for marketing without your explicit consent.

Legal basis: your consent, given when the form is sent. Retention: three years from the last contact.

Payment may be made through a secure Stripe payment link or according to the terms stated in the quote. divewithdelphine.com neither collects nor stores any card data.

Under the GDPR you have the right to access, rectify, erase, restrict and object. You can exercise it through the contact form or by post at the address above.

The content of sessions is confidential and is not shared with any third party.

This site sets no advertising cookies, no analytics cookies and no third-party trackers.

Fonts and presentation videos are hosted on the site itself: no request is sent to a third-party service during your visit.

YouTube videos offered on some pages load only after you click; at that point YouTube may set its own cookies. Until you click, nothing is loaded.
